Chalk Golf Creator Program Terms

1. The program

The Chalk Golf Creator Program (the "Program") pays you a share of what Chalk Golf ("we", "us") receives when golfers who use your code subscribe to Chalk Golf Pro. You join when we give you a code, and by sharing it you agree to these terms.

2. Joining

2.1. You must apply at chalkgolfapp.com/creators or in the Chalk Golf app, and we must approve you. We can decline any application without giving a reason.

2.2. To join you must be 18 or over and live in the UK. The details you give us must be true and kept up to date. We may ask you to confirm who you are or that you run the channels you named.

2.3. We handle your details as described in our privacy policy.

3. Your code

3.1. Golfers enter your code in the Chalk Golf app. Each golfer can enter one code, once, and cannot change it afterwards.

3.2. A code only counts for a golfer who is not already a Pro subscriber when they enter it.

3.3. You cannot use your own code, or have it used on accounts you own or control.

4. What you earn

4.1. You earn the commission rate we agree with you (25% unless we agree otherwise in writing) of the net revenue from each Pro payment made by a golfer who used your code.

4.2. Net revenue is what we actually receive: the price paid less VAT and other sales taxes, and less the fees kept by Apple or Google. Payments made in other currencies are converted to pounds sterling at the European Central Bank reference rate on the day we record them.

4.3. Golfers who use your code get their first month of Pro free. That month earns nothing. You then earn on a golfer's payments for 12 months from their first paid payment: up to 12 monthly payments or one annual payment.

5. The 60-day hold

Each commission is held for 60 days after the payment it comes from, so that refunds and chargebacks can come through first. A held commission is not yet owed to you.

6. Refunds and chargebacks

6.1. If a payment is refunded or charged back while its commission is on hold, that commission is cancelled.

6.2. If a payment is refunded or charged back after we have paid you for it, we deduct that commission from your future earnings. If a refund is later reversed, the commission is restored.

6.3. No commission is earned on payments that are fraudulent, made from accounts you own or control, or otherwise made in breach of these terms. We may withhold or deduct such commissions, and if we have already paid them you agree to repay them on request.

7. Payouts

7.1. On the 1st of each month we total the commissions that have cleared the hold. If the total is £25 or more, we pay it in pounds, by PayPal or bank transfer to the account you've given us, normally within 10 working days. Smaller totals carry over to the next month.

7.2. You are responsible for giving us correct payout details. We are not responsible for payments sent to details you supplied.

7.3. If you choose PayPal, any fee PayPal charges you for receiving the payment comes out of what you receive.

7.4. You can see your held, cleared and paid commissions in the Creator screen of the Chalk Golf app.

8. Tax

You are an independent contractor, not an employee. Commissions are paid without any deduction for tax or National Insurance, and you are responsible for declaring and paying any tax due on them. All commission amounts include any VAT that may be due on them.

9. How you promote Chalk

9.1. You must:

• label every post, video or story that includes your code as advertising (for example with "#ad" at the start), in line with the CAP Code and CMA guidance on influencer marketing;
• describe Chalk Golf accurately, and only make claims about its features that you have seen in the app.

9.2. You must not:

• bid on "Chalk Golf" or similar terms in paid search ads;
• post your code on coupon, voucher or cashback sites without our written permission;
• send unsolicited messages, or offer golfers money or rewards to subscribe and then cancel or ask for a refund;
• say or suggest that you speak for Chalk Golf, or use our name or logo other than to promote your code.

10. Changes and ending the program

10.1. We may change these terms, including your commission rate, by giving you at least 30 days' notice by email. Changes apply to payments made after the change takes effect.

10.2. Either of us can end your participation at any time by email. Your code then stops working for new golfers. Commissions on payments made before the end date are still paid after the hold, as usual.

10.3. If we end your participation because you broke these terms, any commissions not yet paid are forfeited.

11. General

11.1. The Program is not exclusive: you can promote other products, and we can work with other creators.

11.2. Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability to you under the Program is limited to the commissions payable to you in the 12 months before the claim.

11.3. These terms are governed by the laws of England and Wales, and disputes will be settled in the courts of England and Wales.
