Terms of Service for Chalk Golf

1. Introduction

Welcome to Chalk Golf ("we", "our", or "us"). Chalk Golf is run by Andrew Keogh, trading as KeoooDev. These Terms of Service ("ToS") govern your use of the Chalk Golf platform, an all-round golf app that lets you track rounds, log shots by voice, save course notes, manage practice sessions, play with friends, work with your golf coach, and monitor green-fee and tournament-entry budgets (the "Service").

The Service includes the Chalk Golf apps for iPhone and Android, the Apple Watch and Wear OS apps, Chalk Tracer for Mac and Windows, the Chalk Golf connector for AI assistants, and chalkgolfapp.com.

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these ToS and all terms incorporated by reference. If you do not agree to these ToS, do not use the Service.

We may require you to actively confirm acceptance of these Terms and acknowledgement of our Privacy Policy when creating or accessing an account.

3. Changes to ToS

We may update these ToS from time to time. If we make a significant change, we will give notice before it takes effect by email to the address on your account, by an in-app notification, or by a prominent notice on our website.

The updated ToS will include the new effective date. If you continue to use the Service after that effective date, you accept the updated ToS.

4. Use of Service

4.1. You must use the Service in accordance with these ToS and all applicable EU, UK, and member state laws.

4.2. You must be at least 13 years old (16 in the UK and EU) to use the Service or hold an account.

4.3. You are responsible for any content you upload — including rounds, shots, course notes, scorecard photos, voice transcripts, clips, comments, drawings, voice notes and drills. You represent that you have all necessary rights to that content and that submitting it does not infringe any third party rights.

4.4. You are responsible for keeping your sign-in method secure and for any activity that takes place under your account.

5. Data Protection & Privacy

5.1. By using the Service, you acknowledge and consent to our processing of your personal data in accordance with our Privacy Policy.

5.2. We comply with the UK GDPR and the EU General Data Protection Regulation. You have rights to access, rectify, or erase your personal data, and you can exercise these rights by contacting us.

5.3. Marketing emails are optional. They are not required to create or use an account. You can opt in where we offer that choice and you can opt out at any time through your account settings or the unsubscribe link in a marketing email.

6. Intellectual Property

6.1. By using the Service, you grant us a non-exclusive, royalty-free licence to use your content solely to provide the Service to you (including transmitting it to the third-party AI and infrastructure providers listed in the Privacy Policy). We do not use your content to train third-party AI models.

6.2. All rights to the Service and its technology remain with Chalk Golf or its licensors.

7. Disclaimers

7.1. The Service is provided "as is" without any express or implied warranties.

7.2. We do not guarantee the accuracy or completeness of any GPS-derived distance, AI-generated transcript, scorecard scan result, or round analysis. Use your own judgement on the course.

8. Subscriptions

8.1. Chalk Golf Pro is an auto-renewing subscription. The price, the length of each renewal period and any free trial are shown before you pay. One Pro subscription unlocks Pro on every Chalk Golf app you sign in to with the same account. Subscription state is managed for us by a third-party subscription provider. Who takes your payment depends on where you buy:

• App Store.Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel it in your App Store account settings. Refunds are handled by Apple under Apple’s rules.
• Google Play.Payment is charged to your Google account when you confirm the purchase. The subscription renews automatically until you cancel it in Google Play under Payments & subscriptions. Refunds are handled by Google under Google Play’s rules.
• On the web(for example from Get Pro in Chalk Tracer). Payment is taken by our subscription provider’s payment processor. The subscription renews automatically until you cancel it from the manage-subscription link in your receipt email, or by emailing us.

8.2. Cancelling stops future renewals. You keep Pro until the end of the period you have already paid for.

8.3. Free trials and free months (for example from a creator’s code) turn into a paid subscription at the price shown when you started the trial, unless you cancel before the trial ends.

8.4. Right to cancel web purchases. If you live in the UK or EU and buy Pro or a Coach plan on the web, you normally have 14 days to cancel. Your plan starts as soon as you pay. Where we ask you at checkout to agree that it starts straight away, you lose the right to cancel once it does. If you weren’t asked for that agreement, you can cancel within 14 days of buying for a full refund by emailing us. App Store and Google Play purchases follow Apple’s and Google’s cancellation rules.

8.5. Free-tier features may have monthly or daily quotas (for example, AI round analyses or scorecard scans). Pro removes or increases these. Quotas may change; we will tell you in-app before reducing anything you have already paid for.

8.6. Coach plan. Coach Unlimited (unlimited clients) is £49.99 a month or £499 a year (UK prices; the price for your country is shown before you pay). It includes Pro, and it is an auto-renewing subscription bought in the app or on the web from the coach portal, so 8.1 to 8.4 apply to it as they do to Pro. Without a plan you can coach one client free, for as long as you like. Where a free trial is offered, 8.3 applies.

8.7. If your Coach plan ends, nothing is deleted. Your clients stay linked and you can still read their clips, comments and shared stats, but you can’t comment or add clients, apart from your one free client, until you buy a plan again.

8.8. Golfers pay nothing to work with their coach. Sending clips to your own coach doesn’t need Pro.

9. Acceptable Use

You agree not to: abuse the AI quotas or backend API, upload unlawful, threatening, or malicious content, scrape or reverse-engineer the Service, or impersonate other players.

9.1. These rules cover everything other players can see: event wall posts, your profile name, username and avatar, shares, the friends feed, match, trip, team and season names, course details you add or edit, coach profiles, and coaching comments, drawings, voice notes and drills. We have zero tolerance for objectionable content and abusive players: no hate, harassment, bullying, sexual content, threats, violence, scams, illegal content, or content you don’t have the right to share.

How we keep players safe

9.2. Event walls are only visible to players in that event, and shares and the friends feed only to friends you have accepted. There are no direct messages: coaching comments only happen on clips and rounds inside an active coaching link. You can block a player, which hides their wall posts and shares from you and ends any coaching link with them, and you can hide any wall post. Event hosts can remove any post on their event.

9.3. You can report a wall post or a coaching comment in the app. To report anything else, or a player, email support@chalkgolfapp.com with “Report” in the subject and tell us what and where it is. A reported wall post is hidden from you straight away. We review reports within 24 hours and take down illegal content as soon as we know about it.

9.4. We automatically block wall messages that contain slurs on our word list, and we limit how many posts an account can make in an hour. We don’t scan photos or videos automatically.

9.5. When content breaks these rules we remove it, and we may suspend or close the accounts responsible. We report child sexual abuse material and credible threats to life to the police or the National Crime Agency.

9.6. Complaints. You can complain to us if you think content on Chalk Golf is illegal or breaks these rules, if we didn’t handle your report properly, or if we removed your content or restricted your account and you think we got it wrong. Email support@chalkgolfapp.com with “Complaint” in the subject. We’ll acknowledge it within 7 days, look into it, and tell you what we decided and why. If we got it wrong, we’ll put your content or account back.

10. Coach Mode

10.1. Coaches are independent. They are not our employees or agents, and we don’t vet, check or endorse them. A PGA number, club or academy on a coach profile is what the coach entered, and we don’t verify it. Each coach is responsible for their own coaching advice, and any lesson, booking or payment is between the coach and the golfer.

10.2. A coaching link starts when one of you invites the other and the other accepts. Either of you can end it at any time, and access ends straight away. Comments, drawings and voice notes only happen inside an active link, never as direct messages. Use them for coaching, under the rules in section 9.

10.3. Coaches working with under-18s must follow their safeguarding obligations, such as their governing body’s safeguarding policy. Golfers under 18 who add their year of birth show a junior badge to their coach.

10.4. If you coach, you are responsible for what you keep in your client notes and for your own obligations to your clients, including under data protection law.

10.5. We can remove coaching content and end coaching links that break these ToS, and suspend or close the accounts responsible.

11. Limitation of Liability

To the extent permitted by EU and UK law, we are not liable for indirect or consequential damages or losses arising from your use or inability to use the Service (including missed cuts, lost bets, or wounded pride).

12. Indemnity

You will indemnify us against claims arising from your use of the Service or breach of these ToS.

13. Termination

Either of us can end this agreement at any time. You can delete your account from Settings inside the app; we may suspend or terminate an account that breaks these ToS. The deletion section of the Privacy Policy controls what happens to your data.

14. Governing Law & Jurisdiction

These ToS are governed by the laws of England and Wales. Disputes will be settled in the courts of England and Wales.

15. Consumer Rights

Users residing in the UK or EU are entitled to certain statutory consumer rights. Nothing in these ToS intends to restrict those statutory rights.

16. Apple-Specific Terms

Where you obtain Chalk Golf through the Apple App Store, the following additional terms apply, to the extent required by Apple:

• These ToS are between you and Chalk Golf only, not with Apple. Apple is not responsible for the Service or its content.
• The licence granted to you for Chalk Golf is limited to a non-transferable licence to use the app on Apple-branded products you own or control, in accordance with the Usage Rules in Apple’s App Store Terms of Service.
• Apple has no obligation to furnish any maintenance or support services for Chalk Golf.
• In the event Chalk Golf fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Chalk Golf.
• We — not Apple — are responsible for addressing any claims relating to Chalk Golf, including product liability, failure to conform to any applicable legal or regulatory requirement, and consumer protection claims.
• You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these ToS, and upon your acceptance of these ToS, Apple has the right (and is deemed to have accepted the right) to enforce them against you.

17. Course data

Course names, locations, maps and many scorecards come from open data: © OpenStreetMap contributors, yardage-hub and OpenGolfAPI, available under the Open Database License. Course details can be wrong or out of date, so check the card at the club.
