Terms of Service for Chalk Golf

1. Introduction

Welcome to Chalk Golf ("we", "our", or "us"). These Terms of Service ("ToS") govern your use of the Chalk Golf platform, an all-round golf app that lets you track rounds, log shots by voice, save course notes, manage practice sessions, and monitor green-fee and tournament-entry budgets across our mobile app and website (the "Service").

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these ToS and all terms incorporated by reference. If you do not agree to these ToS, do not use the Service.

We may require you to actively confirm acceptance of these Terms and acknowledgement of our Privacy Policy when creating or accessing an account.

3. Changes to ToS

We may update these ToS from time to time. If we make a significant change, we will give notice before it takes effect by email to the address on your account, by an in-app notification, or by a prominent notice on our website.

The updated ToS will include the new effective date. If you continue to use the Service after that effective date, you accept the updated ToS.

4. Use of Service

4.1. You must use the Service in accordance with these ToS and all applicable EU, UK, and member state laws.

4.2. You must be at least 13 years old (16 in the UK and EU) to use the Service or hold an account.

4.3. You are responsible for any content you upload — including rounds, shots, course notes, scorecard photos, and voice transcripts. You represent that you have all necessary rights to that content and that submitting it does not infringe any third party rights.

4.4. You are responsible for keeping your sign-in method secure and for any activity that takes place under your account.

5. Data Protection & Privacy

5.1. By using the Service, you acknowledge and consent to our processing of your personal data in accordance with our Privacy Policy.

5.2. We comply with the UK GDPR and the EU General Data Protection Regulation. You have rights to access, rectify, or erase your personal data, and you can exercise these rights by contacting us.

5.3. Marketing emails are optional. They are not required to create or use an account. You can opt in where we offer that choice and you can opt out at any time through your account settings or the unsubscribe link in a marketing email.

6. Intellectual Property

6.1. By using the Service, you grant us a non-exclusive, royalty-free licence to use your content solely to provide the Service to you (including transmitting it to the third-party AI and infrastructure providers listed in the Privacy Policy). We do not use your content to train third-party AI models.

6.2. All rights to the Service and its technology remain with Chalk Golf or its licensors.

7. Disclaimers

7.1. The Service is provided "as is" without any express or implied warranties.

7.2. We do not guarantee the accuracy or completeness of any GPS-derived distance, AI-generated transcript, scorecard scan result, or round analysis. Use your own judgement on the course.

8. Subscriptions

8.1. Chalk Golf Pro is offered as an auto-renewing subscription through Apple’s in-app purchase system and managed via a third-party payment provider. Pricing and the length of each renewal period are shown in the app at the point of purchase.

8.2. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period.

8.3. You can manage and cancel your subscription at any time from your App Store account settings. Cancelling stops future renewals; you keep Pro access until the end of the period you have already paid for.

8.4. Refund requests are handled by Apple directly. They own the transaction and apply their own refund rules.

8.5. Free-tier features may have monthly or daily quotas (for example, AI round analyses or scorecard scans). Pro removes or increases these. Quotas may change; we will tell you in-app before reducing anything you have already paid for.

9. Acceptable Use

You agree not to: abuse the AI quotas or backend API, upload unlawful, threatening, or malicious content, scrape or reverse-engineer the Service, or impersonate other players.

10. Limitation of Liability

To the extent permitted by EU and UK law, we are not liable for indirect or consequential damages or losses arising from your use or inability to use the Service (including missed cuts, lost bets, or wounded pride).

11. Indemnity

You will indemnify us against claims arising from your use of the Service or breach of these ToS.

12. Termination

Either of us can end this agreement at any time. You can delete your account from Settings inside the app; we may suspend or terminate an account that breaks these ToS. The deletion section of the Privacy Policy controls what happens to your data.

13. Governing Law & Jurisdiction

These ToS are governed by the laws of England and Wales. Disputes will be settled in the courts of England and Wales.

14. Consumer Rights

Users residing in the UK or EU are entitled to certain statutory consumer rights. Nothing in these ToS intends to restrict those statutory rights.

15. Apple-Specific Terms

Where you obtain Chalk Golf through the Apple App Store, the following additional terms apply, to the extent required by Apple:

• These ToS are between you and Chalk Golf only, not with Apple. Apple is not responsible for the Service or its content.
• The licence granted to you for Chalk Golf is limited to a non-transferable licence to use the app on Apple-branded products you own or control, in accordance with the Usage Rules in Apple’s App Store Terms of Service.
• Apple has no obligation to furnish any maintenance or support services for Chalk Golf.
• In the event Chalk Golf fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Chalk Golf.
• We — not Apple — are responsible for addressing any claims relating to Chalk Golf, including product liability, failure to conform to any applicable legal or regulatory requirement, and consumer protection claims.
• You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these ToS, and upon your acceptance of these ToS, Apple has the right (and is deemed to have accepted the right) to enforce them against you.
